# Trademark filing checklist (not filed)

This is an **owner checklist** for a possible later filing at the [United States Patent and Trademark Office](https://www.uspto.gov) and, if relevant, other offices. It is **not legal advice**, not a clearance opinion, and **not a trademark application**.

**No trademark application is filed by this commit.** This repository has no USPTO serial number, no registration number, and no ® claim. Publishing TRADEMARKS.md does not file anything.

Claimant of the unregistered marks: **Tyler Michael Bosworth**. Intended publisher name: **Soul Consciousness Studios** (not automatically an owner entity).

## Before anyone files

1. **Retain a U.S. trademark attorney.** Identification of goods/services, class choice, specimens, and likelihood-of-confusion analysis are professional work. This file cannot substitute.
2. **Search.** A preliminary exact-word internet search is a knockout screen only. Before filing, search USPTO (TESS / Trademark Search), relevant state trademark and business-name databases, common-law web use, domains, app stores, software directories, and any foreign markets where sales are planned. Compare sound, appearance, meaning, translation, and commercial impression in **related** goods/services, not only identical names. Preserve dated queries and results privately. 3. **Decide the applicant.** File in the name of whoever actually owns the mark. Until a formed entity exists **and** a signed assignment is executed, that is Tyler Michael Bosworth personally—not "Soul Consciousness Studios" as a company.
4. **Decide the filing basis** with counsel (use in commerce vs. intent-to-use). Do not declare use in commerce that has not occurred. Do not declare dates you cannot prove.
5. **Specimens.** For downloadable software, USPTO typically expects a specimen showing the mark as used on the goods or in a manner that creates an association with the software (for example a screenshot of the app title bar / About screen, or a download page that displays the mark in connection with the installer). A LICENSE file alone is often a poor specimen. Do not fabricate screenshots that misstate registration.
6. **International.** USPTO registration is United States-only. Madrid Protocol / foreign offices are separate, need local advice, and are not started by this commit.

## Classes often discussed for software (attorney must confirm)

These Nice / USPTO class numbers are **starting points**, not a filing:

Do **not** copy another company's identification of goods word-for-word. Do **not** claim live payment processing, neural TTS, VRM, or iOS apps that this product does not ship. Overbroad identifications invite refusal or later fraud-on-the-office risk.

"Soul" as a standalone Class 9 mark may face descriptiveness, genericness, or crowded-field objections. Counsel should advise whether to file Soul at all, file it only as a feature used *with* Eidovara, or skip it.
